If you live in California and do not have a Federal Firearms License and intend to buy a modern/ curio handgun please read the following.


EFFECTIVE JANUARY 2003 HAND GUN DELIVERIES WILL REQUIRE ADDITIONAL PROCEDURES.

Effective January 1, 2003, dealers must record and retain the purchaser's right thumbprint on the back of the D.R.O.S.

Effective January 1, 2003, prior to the delivery of a handgun, dealers will be required to:

  • Obtain a photocopy of the purchaser's California residency documentation as proof of compliance.

  • Retain a photocopy of the purchaser's valid Handgun Safety Certificate (HSC) card as proof of compliance.

  • Ensure that the purchaser has successfully performed a safe handling demonstration with the handgun that is being purchased. A DOJ Certified Instructor must evaluate the demonstration. The dealer and purchaser must sign an affidavit as proof of compliance.


BFSC Program Replacement

Effective January 1, 2003, the existing BFSC Program will be repealed from law and replaced with the new HSC Program. Accordingly, all previously issued BFSC cards will no longer be valid for handgun purchases after December 31, 2002. Handgun purchases beginning January 1, 2003 require a valid HSC card. HSC cards are valid for five years from date of issuance. In preparation for the HSC Program implementation, DOJ will make HSC materials available to firearms dealers no later than November 2002, allowing them for use in December 2002. Persons redeeming their own handgun(s) as a result of a consignment transaction are exempt from the HSC and safe handling requirements.

Exemptions:

  1. A 12071 PC licensed firearms dealer.

  2. Importers and manufacturers of firearms licensed to engage in that business pursuant to Chapter 44 (commencing with Section 921) of Title 18 of the United States Code and the regulations issued pursuant thereto.

  3. Military
    a) An active member of the United States Armed Forces, the National Guard, the Air National Guard, and the active reserve components of the United States.
    b) Any person honorably discharged from United States Armed Forces, the National Guard, the Air National Guard, and the active reserve components of the United States.

  4. Peace Officers
    a) Any California or federal peace officer who is authorized to carry a firearm while on duty.
    b) Any honorably retired peace officer which includes any: sheriff, under sheriff or deputy sheriff; chief of police or police officer of a city or district; marshal or deputy marshal of a municipal court; constable or deputy constable of a judicial district; port warden or special officer of the Harbor Department of the City of Los Angeles; inspector or investigator of a district attorney's office; California Highway Patrol peace officer; California State Police peace officer; University of California Police peace officer; Law Enforcement Liaison Unit member of the Department of Corrections; Department of Fish and Game employees designated by the director as peace officers; Department of Parks and Recreation employees designated by the director as peace officers; the Director of Forestry and Fire Protection and employees designated by the director as peace officers; Department of Alcoholic Beverage Control employees designated by the director as peace officers; and, a Department of Correction or Department of the Youth Authority parole officer or correctional officer.
    c) Any honorably retired federal officers or agents who were authorized to, and did, carry firearms in the course and scope of their duties (i.e., the Federal Bureau of Investigation, the Secret Service, the United States Customs Service, The Federal Bureau of Alcohol, Tobacco and Firearms, the Federal Bureau of Narcotics, the Drug Enforcement Administration, the United States Border Patrol, and the Internal Revenue Service.)

  5. Any person who has a permit to carry concealable firearms.

  6. Any person who has a certificate of competency or a certificate of completion in hunter safety which bears a hunter safety instruction validation stamp affixed to it.

  7. Any person who holds a valid hunting license issued by the State of California.

  8. Persons authorized to carry loaded firearms pursuant to 12031© and (d) PC who have completed a firearms training course approved by the Commission on Peace Officer Standards and Training (P.O.S.T.)
    a) Patrol special police officers appointed by the police commission of any city or county.
    b) Animal control officers or zookeepers.
    c) Harbor police officers.
    d) Guards or messengers of common carriers, banks and other financial institutions.
    e) Guards of contract carriers operating armored vehicles.
    f) Private investigators and private patrol operators licensed pursuant to Chapter 11.5 of Division 3 of the Business and Professions Code.
    g) Alarm company operators licensed pursuant to Chapter 11.6 of Division 3 of the Business and Professions Code.
    h) Uniformed security guards or night watch persons.

  9. Any person issued a Department of Consumer Affairs certificate pursuant to Section 12033 PC for successfully completing a course in the carrying and use of firearms and a raining course in the exercise of the power of arrest.

  10. Any basic firearms safety instructor certified by the Department of Justice.

  11. Any authorized participant of shooting matches approved by the Director of Civilian Marksmanship.

  12. Any persons who have successfully completed a Commission on Peace Officers Standards and Training (P.O.S.T.) approved course specified in Section 832 PC.

    GREG MARTIN AUCTIONS WILL NOT ALLOW ANY PURCHASER OF A CONCEALABLE FIREARM TO LEAVE THE PREMISES WITHOUT SUPPLYING A COPY OF THEIR BFSC LICENSE OR A COPY OF THEIR EXEMPTION STATUS.

    WALK-UP REGISTRATION OF FIREARMS IS ONLY AVAILABLE THE DAY OF THE AUCTION.
